Oregon’s 2026 Legislature Creates a “FastTrack” Permitting Program — $100M Threshold for Metro Projects, Just $25M for Rural Counties

Oregon lawmakers passed a new FastTrack Permitting Program in the 2026 session, placing a Joint Permitting Council within the Governor’s Office to improve predictability, coordination, and competitiveness for major investment projects — with investment thresholds set at $100 million for metropolitan areas, $50 million for medium-sized counties, and just $25 million for rural counties, reflecting how differently a “transformational project” looks across the state. The session also approved a $40 million investment in industrial site readiness through the Industrial Site Loan Fund, aimed at ensuring development sites are shovel-ready so Oregon can respond quickly when major employers look to expand or relocate. Supporters specifically noted the program accounts for modern project realities — recognizing that today’s capital-intensive, technology-driven projects involve longer construction schedules and more complex supply chains than in years past. For Oregon contractors, particularly those in rural and mid-size counties, this is a meaningful signal that permitting bottlenecks on large commercial and industrial projects may finally start easing — worth watching closely as the Joint Permitting Council begins operating later this year.
