SB 426 Webinar Signals a Coming Compliance Headache for Oregon Contractors

Oregon contractors and project owners have a new compliance question to reckon with: whether they could be on the hook to pay for labor twice under newly passed Senate Bill 426. Law firm Miller Nash hosted a free webinar this week — “Navigating Oregon’s New Construction Labor Payment Law” — aimed at walking owners and contractors through the bill’s mechanics and what it could mean for payment practices on active projects.

We’ve been tracking Oregon’s legislative enforcement framework closely this year, alongside HB 4089 and HB 4012, and SB 426 fits the broader pattern: state lawmakers tightening the rules around how labor gets paid and verified on construction projects, with real financial exposure for contractors who get it wrong.

The double-payment risk is the headline concern — if a subcontractor or laborer isn’t paid properly further down the chain, the law could expose owners and general contractors to a second payment obligation even after they’ve already paid once. That’s the kind of provision that changes how GCs vet subs and how owners structure payment terms.
