Washington Lawmakers Push Permit Reform With Teeth — Refunds Promised If State Agencies Miss Deadlines

Washington lawmakers are advancing companion bills — Senate Bill 5968 and House Bill 2198 — that would bring real accountability to state permitting and licensing, building on Governor Bob Ferguson’s Executive Order 25-03 by requiring state agencies to publish permit and licensing data, set clear decision deadlines, and refund application fees if those deadlines aren’t met. The bills drew a notably broad coalition of support, including the Association of Washington Business, the Washington State Building and Construction Trades Council, the Washington Public Ports Association, and the union representing plumbers, pipefitters, and HVAC/R technicians — with supporters citing real cases where permitting delays caused construction costs to spike so much that approved projects became financially unviable before a single shovel hit the ground. On the housing side, the Building Industry Association of Washington is also pushing a 2026 priority package that would allow licensed professionals to certify code compliance to fast-track project approvals, encourage permitting authorities to use AI to streamline permit intake, allow administrative plat approval, and require local development codes to use clear, measurable, objective standards rather than subjective interpretation. That pro-housing push has unusually high-profile backing — top Amazon and Microsoft executives co-authored a Seattle Times op-ed urging lawmakers to cut red tape and “build our way out” of the housing crisis, specifically endorsing faster permitting alongside zoning reform proposals like SB 6026. For NW contractors who have felt the pain of unpredictable permitting timelines, this is a significant package to watch — especially the fee-refund accountability mechanism, which would be a meaningful first in either state.
